BER CERTIFICATES – NEW REGULATIONS ON ADVERTISING
From the 9th January 2013, a person offering a property for sale or for rent must display the energy performance indicator of their current BER Certificate in any advertisement of the property for sale or to let. Under the relevant legislation ( S.I. 243 of 2012) this requirement relates to all marketking material including newspapers, magazines, brochures, leaflets, signs, television, radio and the internet and furthermore relate to advertisements placed privately or through an agent.
Previously, an owner or landlord was required to obtain a BER Certificate but this was only made available when sought by the buyer or tenant. The new regulations mean that the BER rating which grades property from A to G, with A being the most energy efficient, is prominently displayed .
Failure to comply with the regulations may result in a fine of up to €5,000.
